Terms and Conditions

1. Definitions

Ofinie: A sole proprietorship established under Dutch law, based in Amsterdam, The Netherlands, registered with the Chamber of Commerce under number 57055548.

Customer: A natural person acting for purposes outside their trade, business, craft or profession (consumer).

Products: All goods offered on Ofinie.com.

Agreement: Any agreement concluded between Ofinie and the Customer via Ofinie.com.

2. Applicability

These Terms and Conditions apply to all offers, orders, and agreements between Ofinie and the Customer.

Before concluding an agreement, these Terms and Conditions will be made available to the Customer in a way that allows them to be stored for future reference.

3. Offer and Agreement

  • All offers are non-binding unless explicitly stated otherwise.

  • The agreement is concluded when the Customer places an order and receives an order confirmation by email.

  • Ofinie reserves the right to refuse or cancel orders in case of suspected fraud or incorrect information.

4. Prices and Product Information

  • All prices include VAT and exclude shipping costs unless stated otherwise.

  • Shipping costs are clearly communicated before checkout.

  • Ofinie strives to ensure all information is accurate, but obvious errors (e.g. pricing mistakes) are not binding.

  • Product images are indicative; slight variations in color or appearance may occur.

5. Delivery and Performance

  • Orders are processed as soon as possible after confirmation.

  • Orders placed after 17:00 CET on Friday will be processed the next business day.

  • Delivery times are indicative and not guaranteed.

  • Risk of damage or loss passes to the Customer upon delivery.

6. Right of Withdrawal (Return Policy)

In accordance with the EU Consumer Rights Directive and Dutch law:

  • The Customer has the right to withdraw from the agreement within 14 days without giving any reason.

  • The withdrawal period expires 14 days after the day the Customer (or a third party designated by them) receives the product.

How to exercise the right of withdrawal

The Customer must inform Ofinie via:

Return conditions

  • Products must be returned unused, unworn, and in original condition and packaging.

  • The Customer bears the direct cost of returning the goods unless otherwise stated.

Refunds

  • Ofinie will refund all payments received (including standard shipping costs) within 14 days after being informed of the withdrawal.

  • Refunds may be withheld until the returned goods are received or proof of return is provided. In case of any proof of usage of the goods, Ofinie can reject the withdrawal request and return the goods to the Customer.

7. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Sealed products that are not suitable for return for health or hygiene reasons, once unsealed after delivery

  • Custom-made or personalized products

8. Defective Products and Legal Guarantee

  • Customers are entitled to a legal guarantee under Dutch law.

  • Products must conform to the agreement (be what the Customer can reasonably expect).

  • In case of defects within the warranty time of 1 year, the Customer may request repair, replacement, or (partial)refund.

9. Complaints Procedure

  • Complaints must be submitted within a reasonable time after discovery.

  • Customers can submit complaints via email or contact form.

To process complaints efficiently, include:

  • Order number

  • Name

  • Description of the issue

  • Photo/video evidence (if applicable)

  • Ofinie will respond within 5 business days.

10. Payment

Payment methods include:

  • Wero

  • PayPal

  • MasterCard

  • Klarna

  • Amex

  • Apple Pay
  • Google Pay
  • Union Pay
  • Visa
  • Shop (Shopify pay)

Payment must be completed before shipment unless otherwise agreed.

11. Promotional Codes

  • Promotional codes are subject to specific terms provided at issuance.

  • Codes cannot be exchanged for cash and may have expiration dates.

12. Liability

  • Ofinie is not liable for indirect or consequential damages unless caused by intent or gross negligence.

  • Liability is limited to the purchase amount of the product.

13. Privacy and Personal Data

Ofinie processes personal data in accordance with applicable privacy laws, including the General Data Protection Regulation.

14. Retention of Title

Ownership of products remains with Ofinie until full payment has been received.

15. Applicable Law

All agreements are governed by Dutch law.
